1. Privacy Notice

At ECO3 BV, Septestraat 27, 2640 Mortsel, (“ECO3”), we take the protection of your personal data very seriously.

We conduct our business in compliance with Regulation (EU) 2016/679 of the European Parliament and Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

The purpose of this privacy notice is to explain to you what personal data ECO3 collects, how ECO3 uses and stores this personal data and with whom ECO3 may share it.

You can use our website without disclosing your personal data. However, providing your personal data might be necessary if you request certain services or information from us, such as the downloading of a white paper, asking for an appointment at an event, asking for more information about our products and/or services, and by doing so you provide your consent for such collection.

The legal basis for this processing is your consent (Art. 6 para. 1 lit. a GDPR) or our legitimate interest (Art. 6 para. 1 lit. f GDPR). If your request is aimed at the conclusion of a contract, the legal basis for the processing is the performance of a contract (Art. 6 para. 1 lit. b GDPR).

You have the right to withdraw your consent at any time.

ECO3 strives to have in place appropriate technical and organizational means to protect your information. However, you understand that providing your personal data over public networks, is never without risk.

Who collects your personal data?

ECO3 collects, processes and uses your personal data for the purposes of providing you with information that responds to your enquiry (such as information about our products and/or services) and use and management of the ECO3 website in general.

ECO3 may cooperate with external service providers who may also be located in third countries. Third countries are countries where the applicable law does not guarantee the same level of data protection as within the EEA.

International transfer of personal data to third parties is protected using the appropriate contracts and measures.

In the event that a recipient of your personal data is located in a third country for which the EU Commission has not made an adequacy decision to the effect that an adequate level of data protection exists in this third country, ECO3 will take additional measures to implement appropriate guarantees for the protection of your personal data in accordance with the GDPR.

ECO3 transfers personal data to external recipients outside the European Economic Area only if the recipient has (i) entered into EU Standard Contractual Clauses with ECO3 or (ii) implemented Binding Corporate Rules in its organization. What about commercial e-mails?

Specifically, in relation to commercial e-mails that promote ECO3 products and services, ECO3 shall not use your personal data in order to send unsolicited commercial e-mails, unless you have given your consent to receive such e-mails, by ticking the opt-in box in the contact form of our website(s).
At any time, you will have the right to withdraw your consent for any direct marketing purposes. You can communicate this objection by unsubscribing from our e-Newsletter directly in the e-Newsletter itself, by email to compliance@ECO3.com or by letter addressed to our ECO3 Group Compliance Office, Septestraat 27, Room 76-05-21, 2640 Mortsel, Belgium. After receipt of your objection, we shall send you a notice of receipt and we shall register your request. Your request shall imply that we shall not send commercial e-mails that would be considered as unsolicited.

How long may we retain your personal data?

We further store your personal data only as long as necessary for the fulfillment of the purposes for which it has been collected or as required by law.

For personal data stored for marketing purposes, the retention period shall depend on the shelf life of the product or service for which they were collected, with a maximum of three (3) years. You also have the right to update your preferences by opting out, whenever you want.

What are your rights and how can you exercise them?

  • You have the right of access to your personal data and the right to request rectification of incorrect, incomplete or irrelevant data.
  • You have the right to object to processing of your personal data and to obtain the erasure of your personal data.
  • You also have the right to restrict processing of your personal data.
  • When processing of your personal data is based on consent, you also have at any time, the right to withdraw your consent for further processing of your personal data. You understand that the personal data that was disclosed by ECO3 prior to your request to abolish further disclosure is no longer under the control of ECO3.
  • You have a right to request data portability.
